Three years ago our region had severe hail storm, which triggered thousands upon 1000′s of households to file roof and AC claims. Considering that we were in the process of modifying our loan with bank, and uncertain if we are moving or not, we made a decision not to file or have a roof inspected, given that there were no leaks or any visual damage. Two weeks in the past wind blew off portion of the roof and we filed a claim with Statefarm. Given that the injury didn’t exceed our deductible they refused to shell out something, but independent adjuster mentioned that roof is severely damaged, and this was confirmed by 6 roofing contractors. We want new roof. Statefarm mentioned that we want to go back to Allstate, given that we had policy with them at the time, but i am not certain if this is even really worth pursuing. Can this be carried out, now that we do not have policy with them? Independent adjuster would seem to feel so!

    It doesn’t matter who covers you now. It matters who was covering you when the damage occurred.

    Home insurance policies provide coverage on an occurrence basis, meaning whoever insured you at the time of the loss is who covers the damage.

    If Allstate was covering you when the loss occurred, you make your claim under the Allstate contract. Their contract said they would respond to claims for loss or damage between the __th of ___ 2010 and the __th of ___ 2011, so if the loss happened between those two dates they have to cover it as per their legal agreement.
